1. Acceptance of Terms
These Terms and Conditions govern your access to and use of Self Drive Kenya, including the mobile application, website, booking services, owner tools, stay booking services, combo stay-and-drive services, payments, verification, support, and related services.
By creating an account, browsing listings, making a booking, listing a vehicle or stay, accepting a booking, submitting verification documents, or using our services, you agree to these Terms.
2. Platform Role
Self Drive Kenya is a technology platform that helps users discover, book, manage, and pay for vehicle rentals, stay bookings, and combined stay-and-drive packages.
Unless expressly stated otherwise, vehicle owners, stay hosts, and service providers are independent providers. Self Drive Kenya may facilitate payments, verification, booking management, communication, and dispute support, but does not automatically become the owner, operator, insurer, or direct provider of every vehicle or stay listed on the platform.
3. Eligibility
- You must be legally capable of entering into binding agreements.
- You must provide accurate, current, and complete account information.
- You must not impersonate another person or use false documents.
- To rent or drive a vehicle, you must hold a valid driver’s license accepted in Kenya and meet any owner, insurance, age, verification, and eligibility requirements.
- Owners and hosts must have the legal right to list the vehicle, stay, or service.
4. Accounts and Security
You are responsible for keeping your account secure. You must not share your password, OTP, verification credentials, or account access with unauthorized persons.
We may suspend, restrict, or terminate accounts where we detect fraud, misuse, suspicious activity, repeated cancellations, unsafe behavior, false documents, chargeback abuse, illegal activity, or violation of these Terms.
5. Verification and KYC
Self Drive Kenya may require identity verification, phone verification, email verification, license verification, selfie/liveness verification, owner verification, or manual review before you access some features.
Verification does not guarantee that a user, owner, vehicle, stay, or transaction is risk-free. Users must still exercise reasonable care and follow all platform rules.
Submitting false, altered, stolen, expired, or misleading verification documents is strictly prohibited and may result in account termination, booking cancellation, reporting to authorities, and legal action.
6. Bookings
Vehicle Bookings
- Vehicle bookings may include self-drive, chauffeur, pickup location, return location, rental dates, rental duration, extras, delivery fees, deposits, and payment requirements.
- The renter must return the vehicle on time, in the agreed condition, with agreed fuel level, and according to owner rules.
- The renter must not use the vehicle for illegal activity, racing, reckless driving, unauthorized commercial use, subleasing, or transport of prohibited goods.
Stay Bookings
- Stay bookings include check-in/check-out dates, nights, guest count, house rules, cancellation policy, pricing, fees, and owner approval where applicable.
- Guests must respect house rules, property rules, quiet hours, maximum guest limits, and safety requirements.
Combo Bookings
- Combo bookings combine accommodation and vehicle services into one package.
- Combo prices may include stay price, car price, delivery fee, discount, extras, taxes, or service fees where applicable.
- Changes to one part of a combo booking may affect the entire booking price, availability, or approval status.
7. Pricing, Fees, Discounts, and Payments
Prices shown in the app may include base rental rates, nightly rates, delivery fees, cleaning fees, service fees, taxes, discounts, extras, security deposits, late fees, damage fees, and other applicable charges.
Users are responsible for reviewing the total amount before confirming payment. Payment status may be pending, paid, refunded, partially refunded, failed, or disputed depending on the transaction flow.
Discounts are applied according to the rules displayed in the app. Where a pricing error occurs due to technical failure, incorrect data, or misuse, Self Drive Kenya may correct, cancel, refund, or adjust the booking as reasonably necessary.
8. Cancellations, Refunds, and No-Shows
Cancellation and refund rules depend on the listing type, owner/host policy, time before pickup/check-in, payment method, and platform rules.
- Free cancellation may apply only where clearly stated.
- Late cancellations may result in partial or no refund.
- No-shows may be charged according to the applicable policy.
- Refund processing time depends on the payment provider and banking/mobile money networks.
- Self Drive Kenya may withhold refunds where fraud, damage, unpaid fees, chargebacks, or policy violations are under investigation.
9. Owner and Host Responsibilities
Owners and hosts must provide accurate listings, lawful ownership or authorization, correct pricing, real photos, availability, safe vehicles or properties, and truthful descriptions.
- Vehicle owners must ensure vehicles are roadworthy, insured where required, clean, legally compliant, and fit for the listed use.
- Stay hosts must ensure properties are safe, clean, lawful, and consistent with the listing.
- Owners must honor confirmed bookings unless there is a legitimate safety, legal, fraud, or availability issue.
- Owners must not discriminate unlawfully, harass users, request off-platform payments, or misuse user information.
10. Renter and Guest Responsibilities
- Provide accurate identity, contact, license, and booking information.
- Use vehicles and properties responsibly and lawfully.
- Pay all applicable charges, deposits, extras, penalties, damage costs, and late fees.
- Report accidents, theft, breakdowns, damage, disputes, or safety concerns immediately.
- Do not transfer bookings to unauthorized persons.
- Do not exceed passenger limits, guest limits, mileage rules, geographic restrictions, or house rules.
11. Damage, Deposits, Accidents, and Claims
Renters may be responsible for vehicle damage, property damage, traffic fines, towing, impound fees, cleaning fees, lost keys, fuel differences, late return fees, unauthorized use, and other losses caused during the booking period.
Owners and hosts must provide evidence of claims where possible, including photos, inspection reports, receipts, police reports, repair estimates, or other relevant records.
Self Drive Kenya may assist in disputes but may rely on available evidence, platform records, payment records, verification records, and third-party information to make operational decisions.
12. Prohibited Activities
- Using false identity, fake documents, stolen cards, or another person’s account.
- Taking bookings or payments outside the platform to avoid fees or safety checks.
- Harassment, threats, discrimination, violence, fraud, or illegal conduct.
- Using vehicles for racing, reckless driving, criminal activity, unauthorized commercial transport, or prohibited goods.
- Damaging property, violating house rules, exceeding guest limits, or hosting unauthorized events.
- Reverse engineering, scraping, attacking, or disrupting the app, systems, database, or infrastructure.
13. Reviews, Photos, and User Content
Users may upload photos, listing descriptions, reviews, messages, verification documents, and other content. You are responsible for content you provide.
You grant Self Drive Kenya a limited right to use uploaded content to operate, display, market, moderate, support, verify, and improve the platform.
We may remove content that is false, misleading, illegal, abusive, infringing, unsafe, discriminatory, or violates these Terms.
14. Limitation of Liability
To the maximum extent permitted by law, Self Drive Kenya is not liable for indirect, incidental, special, punitive, or consequential damages, including lost profits, lost data, loss of use, personal arrangements, missed trips, or third-party conduct.
Nothing in these Terms excludes liability that cannot legally be excluded.
15. Suspension and Termination
We may suspend, restrict, or terminate access if we believe you violated these Terms, created risk, submitted false information, failed verification, abused payments, caused damage, engaged in fraud, or created safety concerns.
You may stop using the platform at any time. Some information may be retained as required for legal, accounting, dispute, fraud prevention, or safety purposes.
16. Governing Law and Disputes
These Terms are intended for use by Self Drive Kenya in Kenya. Disputes should first be reported to our support team so we can attempt informal resolution.
Where formal legal resolution is required, applicable Kenyan law and competent courts or dispute resolution bodies may apply, unless another mandatory law applies.
17. Changes to Terms
We may update these Terms from time to time. Continued use of the platform after changes means you accept the updated Terms. The “Last Updated” date shows when this page was last revised.

19. Force Majeure
Neither Self Drive Kenya nor users shall be liable for failure to perform obligations due to circumstances beyond reasonable control, including but not limited to:
- Natural disasters (earthquakes, floods, fires, storms)
- War, terrorism, civil unrest, or government actions
- Pandemics, epidemics, or public health emergencies
- Strikes, labor disputes, or supply chain disruptions
- Infrastructure failures (power outages, internet disruptions, network failures)
- Acts of God or other unforeseeable events
During force majeure events, affected parties should notify the other party promptly and make reasonable efforts to minimize impact. Obligations may be suspended during the event and resumed when circumstances permit.
20. Intellectual Property
All content, trademarks, logos, designs, software, code, databases, graphics, user interfaces, and other intellectual property on the Self Drive Kenya platform are owned by or licensed to Self Drive Kenya.
User Restrictions
- Users may not copy, reproduce, distribute, modify, or create derivative works without explicit written permission.
- The Self Drive Kenya name, logo, and branding may not be used without authorization.
- Scraping, data mining, or automated extraction of platform content is prohibited.
- Reverse engineering, decompiling, or disassembling the app or systems is not permitted.
User-Generated Content
Users retain ownership of content they upload (photos, reviews, messages) but grant Self Drive Kenya a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute such content for platform operation, marketing, and improvement purposes.
21. Indemnification
Users agree to indemnify, defend, and hold harmless Self Drive Kenya, its officers, directors, employees, agents, partners, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from:
- User violations of these Terms or applicable laws
- Misuse of the platform, vehicles, or properties
- Damage to vehicles, properties, or third-party assets during bookings
- Accidents, injuries, or harm caused by user conduct
- False information, fake documents, or fraudulent activity
- Third-party claims related to user content, reviews, or communications
- Breach of owner, host, renter, or guest responsibilities
- Unauthorized use of intellectual property or user data
This indemnification obligation survives termination of your account or use of the platform.
22. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court or regulatory authority, the remaining provisions shall continue in full force and effect.
Invalid provisions shall be modified to the minimum extent necessary to make them valid and enforceable while preserving the original intent. If modification is not possible, the invalid provision shall be severed without affecting the validity of the remaining Terms.
23. Entire Agreement
These Terms and Conditions, together with the Privacy Policy, cancellation policies, house rules, listing terms, and any additional policies referenced or incorporated herein, constitute the entire agreement between users and Self Drive Kenya regarding use of the platform.
These Terms supersede all prior agreements, understandings, negotiations, or communications, whether written or oral, relating to the subject matter.
No waiver of any provision shall be deemed a waiver of any other provision or subsequent breach. Failure to enforce any right or provision does not constitute a waiver of that right.
